An assessment and outlook on the fight against corruption in the light of French law, European law and comparative law.
A landmark piece of French legislation, Law No. 2016-1691 of 9 December 2016 on transparency, the fight against corruption and the modernisation of economic life, known as the ‘Loi Sapin II’, has enabled considerable progress to be made in the fight against corruption and in strengthening transparency. The 10th anniversary of its adoption is an opportune moment to take stock and examine its prospects.
An assessment of its key measures – such as the CJIP, the creation of the AFA, the strengthening of compliance requirements, the protection of whistleblowers and the promotion of internal investigations – will be carried out in the light of the requirements of both French and European law (EU law and ECHR law).
A comparative law analysis will explore not only the influence of the Loi Sapin II on the anti-corruption frameworks of other European states but also the prospects for the French system in the context of the harmonisation of European legislation in this area and its significance, given the United States’ retreat from the fight against corruption.
